# 1. SaaS Master Service Agreement

These terms govern use of Certifada, operated by CuspForge Technologies L.L.C., Sharjah Media City, Sharjah, United Arab Emirates. You must have authority to act for the organization you represent. Your accepted order and any signed agreement govern their specific subject matter; the DPA governs customer personal-data processing. Mandatory legal rights remain unaffected. Material changes will be communicated as required by law or your agreement; this page does not retroactively remove accrued rights or existing binding commitments.

# 2. Service Availability & Licensing

You receive a limited, non-exclusive right to use the platform within your plan limits while your account is authorized. Availability of optional features depends on the plan and configuration. Verification reports the issuer’s credential record and status; it does not independently certify a recipient’s competence, accreditation, or legal entitlement. Service levels are described in the SLA and your applicable agreement.

# 3. User Responsibilities & Issuance Authority

You are responsible for issuance authority, accurate recipient information, lawful notices and permissions, and the information you publish in credentials. Protect account credentials and API keys, manage user access, and review designs and recipient lists before issuance. Do not upload personal data that you are not authorized to process or disclose.

# 4. Prohibited Uses & Fraud Prevention

The Acceptable Use Policy applies. We may restrict access or investigate suspected misuse to protect the service, affected people, or comply with law. Action will reflect the circumstances; where appropriate and lawful, we will provide notice and an opportunity to resolve the issue. We may report conduct to authorities where required or legally justified.

# 5. Intellectual Property & Digital Signatures

You retain your rights in the content and branding you provide. You grant us permission to host, process, render, and deliver that content as needed to provide the service. Certifada and its licensors retain rights in the platform and supplied assets. Third-party fonts, artwork, templates, and AI output may carry separate rights or conditions; you are responsible for your permitted use.

# 6. Limitation of Liability

To the extent permitted by applicable law, neither party is liable for indirect, incidental, or consequential loss arising from the service. Certifada’s aggregate liability is limited to fees paid by the customer in the 12 months before the event giving rise to the claim. These limits do not exclude liability that cannot lawfully be excluded or override mandatory consumer or data-protection rights. Specific signed terms apply where they validly provide otherwise.

# 7. Governing Law & Dispute Resolution

Subject to mandatory law and any valid signed jurisdiction agreement, these terms are governed by the laws applicable in Sharjah, United Arab Emirates, and disputes may be brought before the competent courts. Contact hello@cuspforge.com to seek an amicable resolution.
